Terms of Service

These Terms of Service ("Terms") govern your use of RallyPTA, a web application operated by RallyPTA, LLC, a West Virginia limited liability company ("RallyPTA," "we," "us"), that helps parent-teacher associations and organizations ("PTAs," "Organizations") manage membership, dues, volunteers, treasury, and communication. By creating an account or using RallyPTA, you agree to these Terms on behalf of yourself and, if applicable, the Organization you represent.

1. Who can use RallyPTA

RallyPTA is intended for use by adults acting in an officer, volunteer, or administrative capacity for a PTA or similar organization. You must be at least 18 years old to create an account. RallyPTA is not directed at children, and we do not knowingly collect information directly from children — see our Privacy Policy for details on directory information that officers may enter about students.

2. Your Organization's data

When you create an Organization in RallyPTA, that Organization — not RallyPTA — controls the family, member, volunteer, and financial data entered into it. Your Organization is responsible for having the right to collect and use that data (for example, getting appropriate consent from families before adding them to a directory) and for complying with any laws that apply to it, including school-privacy and nonprofit recordkeeping rules. We act as a service provider that stores and processes this data on your Organization's behalf.

3. Payments

RallyPTA uses Stripe to process two distinct kinds of payments:

• Platform subscription fees — what your Organization pays RallyPTA for use of the service, billed via a subscription on your Organization's account.
• Dues and fundraiser payments — money that families pay directly to your Organization (not to RallyPTA) through a Stripe connected account belonging to your Organization. RallyPTA is not a party to these transactions and does not take a cut of dues or fundraiser proceeds; Stripe's own processing fees apply.

You are responsible for reviewing charges in your billing settings and for keeping payment information current. Subscription fees are non-refundable except as required by law or as we otherwise state in writing.

4. Acceptable use

You agree not to use RallyPTA to violate any law, infringe anyone's rights, upload malicious code, attempt to access another Organization's data without authorization, or interfere with the service's normal operation.

5. Account access

RallyPTA uses passwordless email sign-in. You are responsible for keeping access to the email address associated with your account secure, since anyone with access to that inbox can sign in as you.

6. Termination

You may stop using RallyPTA and request deletion of your Organization's account at any time by contacting us. We may suspend or terminate access for violations of these Terms. If an Organization's subscription lapses, we will provide reasonable notice before any data is deleted.

7. Disclaimers & limitation of liability

RallyPTA is provided "as is," without warranties of any kind. RallyPTA is a young product and, while we take reasonable care, we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, RallyPTA is not liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount your Organization paid us in the twelve months before the claim arose.

8. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify officers by email.

9. Governing law

These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles.
